Terms of Service

Purpose

These Terms of Service (these “Terms”) govern your access to and use of STU Golf Studio’s services, including memberships, bookings, and access to the Facility (including through PodPlay).

Scope

These Terms apply to:

  • Your use of our website and any pages we publish (including these Terms)

  • Your use of PodPlay-powered web and mobile experiences to manage memberships, make reservations, and access the Facility

  • Your entry into and use of the STU Golf Studio facility

2) Acceptance of these Terms

By accessing our services, creating an account, purchasing a membership, making a reservation, entering the Facility, or otherwise using our services, you agree to be bound by these Terms.

If you do not agree, do not use the services.

3) Privacy Policy

Our Privacy Policy explains how we collect, use, and share information. It is incorporated into these Terms by reference.

4) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and purchase a membership, unless we explicitly allow otherwise.

You are responsible for ensuring that any guest you bring complies with these Terms and our rules.

5) Accounts and access (PodPlay)

To use key features (including reservations and access), you may need to create an account through PodPlay.

You agree to:

  • Provide accurate information

  • Keep account information up to date

  • Keep login credentials secure

You are responsible for all activity conducted through your account.

6) Memberships (primary use case)

Most of our services are offered via membership.

Membership details (pricing, included hours/credits, booking windows, and any restrictions) will be presented at purchase and/or inside PodPlay and may vary by membership tier.

We may change membership offerings from time to time. Changes generally apply prospectively, and we will provide notice when practical.

7) Reservations and bookings (including any non-member use)

Even if your use is primarily membership-based, reservations may be required to access the Facility.

You agree to:

  • Arrive and depart within your reserved time

  • Leave the space in a clean, tidy condition

  • Follow all Facility rules and safety requirements

We may set limits on reservation length, number of guests, and booking windows.

Cancellation / modification window: Reservations may not be cancelled or modified within 4 hours of the scheduled start time. If you do not show up or do not use the reserved time, the reservation time may still be counted against your monthly membership allotment (or otherwise treated as used), and any applicable charges may still apply.

8) Payments; refunds; Stripe

Payments are processed through Stripe.

You authorize us (and/or Stripe on our behalf) to charge the payment method on file for:

  • Membership fees

  • Reservation fees (if applicable)

  • Taxes (if applicable)

  • Damage, repair, cleaning fees, and other charges permitted by these Terms

Refunds (if any) and cancellation rules will be shown at checkout and/or in PodPlay and may depend on the type of purchase.

9) Facility rules (house rules)

To keep the Facility safe and operating smoothly, you and your guests must follow all posted rules and any instructions we provide.

House rules (non-exhaustive):

  • Clean shoes and clean clubs only.

  • Use only balls and tees provided by the studio.

  • Keep food and drinks at the lounge table. No food or drink inside the simulator bay or near any computer equipment.

  • No smoking or vaping.

  • Maximum of 4 golfers in the studio at a time.

  • No children under 14 without supervision by a non-playing adult.

  • No swinging clubs outside the simulator bay.

  • Only one person in the hitting area at a time.

  • Before swinging, check surroundings for people or obstacles.

  • Shots must be directed toward the impact screen.

  • Report any accidents immediately.

Violation of rules may result in suspension or termination of access and/or membership.

10) Waiver and assumption of risk

Use of the Facility and Equipment involves inherent risks. You may be required to accept a separate Liability Waiver as a condition of membership activation or entry.

11) Video surveillance (security and safety)

The Facility uses video surveillance for security and safety.

12) Door access; PDK; sharing access

If door access is provided through PodPlay and/or a third-party access control system (including PDK), you agree that:

  • You will not share door access links, codes, credentials, or "unlock" functionality with anyone who is not authorized.

  • You will not allow tailgating (allowing another person to enter behind you without authorization).

  • Only registered members and properly invited guests may enter.

  • You are responsible for your guests and for any entry that occurs using your account.

  • We may suspend or terminate access if we believe access credentials have been shared or misused.

13) Prohibited conduct

You may not:

  • Use the Facility in a way that is unsafe, threatening, abusive, or disruptive

  • Tamper with security systems, cameras, or Facility equipment

  • Attempt to access restricted areas

  • Use the services for unlawful purposes

  • Bring illegal drugs onto the premises

  • Use the Facility while visibly intoxicated or in a manner that creates a safety risk to others

14) Damage; repair; cleaning fees

You are responsible for damage caused by you or your guests beyond normal wear and tear.

If we determine that repair or excessive cleaning is required, you authorize us to charge the payment method on file for reasonable costs.

15) Suspension and termination

We may suspend or terminate access to the services (including membership access) if:

  • You violate these Terms or Facility rules

  • Your payment method fails

  • We believe your conduct threatens safety or property

16) Disclaimers

Services are provided on an “AS IS” and “AS AVAILABLE” basis, to the fullest extent permitted by law.

We do not guarantee uninterrupted access to the Facility or any app-based services.

17) Limitation of liability

To the fullest extent permitted by law, STU will not be liable for indirect, incidental, special, consequential, or punitive damages.

To the fullest extent permitted by law, STU’s total liability for any claim arising out of or relating to the services will not exceed the amounts you paid to STU in the six (6) months preceding the event giving rise to the claim.

18) Indemnification

You agree to defend, indemnify, and hold harmless STU and its officers, directors, members, managers, employees, agents, and contractors from claims arising out of:

  • Your (or your guests’) use of the services or Facility

  • Your (or your guests’) violation of these Terms

  • Damage you (or your guests) cause to the Facility or Equipment

19) Governing law; venue

These Terms are governed by California law, without regard to conflict of law rules.

Any dispute must be brought exclusively in state courts located in Los Angeles County, California, or the United States District Court for the Central District of California.

20) Changes to these Terms

We may update these Terms from time to time. The updated version will be posted with a revised effective date.

21) Miscellaneous

If any provision is held unenforceable, the remainder will remain in effect.

These Terms (together with the Privacy Policy and any policies referenced in PodPlay at checkout) are the entire agreement regarding the services.
